This is a petition filed under Section 227 of the Constitution of India seeking the following reliefs:
“(i) To direct the Munsiff's Court, Ponnani to issue carbon copy of the order dated 11.11.2014 in I.A.No.1416/2014 in O.S. No. 109 of 2013 to the petitioner as expeditiously as possible at any rate within a time limit to be fixed by this Hon'ble Court.
(ii) Stay the further proceedings in O.S. No.109/2013 on the file of the Munsiff's Court, Ponnani so as to enable the petitioner to challenge the order in I.A. 1416/2014 in O.S. 109 of 2013.”
2. All that the petitioner prays for at the time of hearing is that there may be a direction to the Munsiff's Court, Ponnani to issue carbon copy of the order dated 11.11.2014 in I.A. 1416 of 2014 so that he can pursue his remedies against the order. He also prays that if in the meanwhile the trial is continued, it may cause irreparable loss and injury.
O.P.(C).2640/2014. 2 Therefore, he prayed that trial of the suit may be deferred for a short period.
3. Considering the nature of the reliefs sought for, it is felt that notice to the respondents is not necessary.
In the result, this Original Petition is disposed of directing the Munsiff's Court, Ponnani to issue carbon copy of the order dated 11.11.2014 in I.A.1416 of 2014 in O.S. No. 109 of 2013 within a period of two weeks from today and in the meanwhile, trial of the suit in O.S. S109 of 2013 shall be kept in abeyance.
