JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 24.03.2017 CORAM THE HONOURABLE THIRU JUSTICE M. DURAISWAMY CRP (PD) No.1086 of 2017 Vijayalakshmi ...Petitioner v.
1. The Village Administrative Officer Kedsarimangalam Village Bhavani Taluk.
2. The Tahsildar Taluk Office, Bhavani
3. The Revenue Divisional Officer Office of the Revenue Divisional Office Gobichettipalayam
4. The District Collector Erode District Collector Office Erode
5. Branch Officer Office of the Principal Accountant General (A & E) 361, Anna Salai Chennai - 600 018. ...Respondents The Civil Revision Petition is filed under Article 227 of the Constitution of India, for numbering and disposal of S.O.P.SR.No.2585 of 2016 on the file of Sub Court, Bhavani.
For Petitioner : Mr.K.Govi Ganesan ORDER The Petitioner has filed the above Civil Revision Petition to direct the Sub Court, Bhavani, to number the Original Petition in S.O.P.SR.No.2585 of 2016 and dispose of the same on merits.
2. Mr.K.Govi Ganesan, learned counsel appearing for the petitioner submitted that though the petitioner has filed the Original Petition in S.O.P.SR.No.2585 of 2016 on 23.03.2016 itself, the Sub Court, Bhavani has not numbered the same, in spite of the fact that, the defects pointed out by the Trial Court were already complied with and the defects were rectified by the petitioner.
3. On a perusal of the docket order passed by the Trial Court, it is clear that the Trial Court, even without applying its mind, has simply returned its papers pointing out some defects.
4. Since the learned counsel made a submission that the petitioner has complied with all the defects pointed out by the Trial Court, the Trial Court is directed to consider the petition and if the petition is in order, number the same. If the petition is not in order, I direct the Trial Court to give an opportunity to the petitioner to make his submissions in the open court with regard to the defects pointed out by the Trial Court and thereafter pass a reasoned order for not numbering the petition.
No costs.
With these observations this Civil Revision Petition is disposed of.
