JUDGMENT / ORDER

The petitioner is the holder of a building permit to construct a residential building. Ext.P1 is the building permit. Based on the above the petitioner wants to extract ordinary earth from the site covered by Ext.P1 permit. For the purpose of removing ordinary earth from the site no permit is required. However, for the purpose of transporting the petitioner requires 'P' form. In view of the above, there shall be a direction to the Geologist to issue necessary 'P' form to the petitioner on being satisfied with the genuineness of the claim of the petitioner based on Ext.P1. However, if the petitioner fails to construct any building pursuant to Ext.P1, it can be concluded that a building permit is obtained defraud the authorities and proceedings can be initiated against the petitioner for violation of the Kerala Miner Minerals (Development & WP(C).No.32505/2014-K.
2 Regulation) Act, and Miner Mineral Concession Rules.
The Writ Petition is disposed of as above.
