JUDGMENT / ORDER

1. By way of the present petition, the petitioner has prayed for the following reliefs:-
"(A) Admit this petition.
(B) This Hon'ble Court be pleased to declare that the action of the respondents in continuing the petitioner as unarmed constable is illegal, unjust, improper and violative of Article 14 and 16 of the Constitution of India as the persons from wait list of the year 1989 were appointed as unarmed constable though they were having lesser merits than the petitioner considering the placement of the petitioner in the select list second lot and declare that the action of the respondents in appointing petitioner in armed category despite recommendation of Recruitment committee is totally illegal and contrary to the recommendations made by Special Committee and petitioner are entitled for being appointed as unarmed police constable right from the date on which candidates from wait list in the third lot were appointed as unarmed constable in the District of Jamnagar and this Hon'ble Court be further pleased to direct the respondents to appoint the petitioner as unarmed police constable in accordance with the decision of this Hon'ble Court in SCA No.4679 of 1991 dated 19.04.2004.
(C) Pending admission, hearing and final decision of this petition, as the posts of unarmed constable in Jamnagar District are vacant, this Hon'ble Court be pleased to direct the respondent authority to decide pending representations annexure A made by petitioner no.1 and 3 as referred to in the petition and pass appropriate reasoned orders for posting them as unarmed constable as they are of the batch of the year 1989.
(D) Grant such other and further reliefs deemed just and proper in the facts and circumstances of the case."
2. The petition came to be admitted vide order dated 04.12.2008.
3. Today, Mr.Rakesh Patel, learned A.G.P. has tendered order dated 17.02.2012 whereby, the competent authority has considered the grievance raised in the present petition. Photo copy of the said order dated 17.02.2012, passed by the Additional Director General of Police (Administration), Gujarat State, Gandhinagar as per the orders passed by the Director General of Police, is taken on record.
4. Mr.H.H.
Joshi, learned counsel appearing for the petitioner does not press this petition as the grievance of the petitioner stand redressed.
5. The petition stands disposed of accordingly. Rule is discharged. No order as to costs.
