(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) This is an application for recall of an order dated September 13, 2010 passed by a Division Bench of this Court by which the Division Bench directed the appellant to remove the office objections before September 27, 2010 failing which, it was ordered, the appeal would stand dismissed.
After hearing Mr Kapadia appearing on behalf of the applicant and after going through the explanation given in the application, we are satisfied that sufficient cause has been made out for non-compliance of the said order. We accordingly allow this application and restore Tax Appeal (Stamp) No.1380 of 2010 after condoning the delay in filing the application, however, on condition that the office objections referred to in the order dated September 13, 2010 must be removed by May 11, 2012. In default, the application will stand dismissed.
The application thus stand disposed of.
