JUDGMENT / ORDER

Heard learned counsel for the applicants and learned Additional Government Advocate.
It is argued by the learned counsel for the applicants that there is no eyewitness account of the incident and it is out of suspicion that the applicants have been implicated on the statement of a person Jodh Singh, who is said to have seen the applicants and co-accused carrying the dead body at 12 mid night. There was no reason for the witness to be present at the spot, at that time. The body was seen hanging from Mango Tree.
Learned A.G.A. argued that the applicants had motive for committing the crime, as there was some monitory dispute between the parties, who were eunuchs.
Having considered submissions of the learned counsel for the parties, without expressing any opinion on the merits of the case, let the applicants Vijay Urf Rupa Kinnar and Manbhari Urf Akbar, involved in Case Crime No. 234 of 2009, under Section 302 of I.P.C., Police Station Biharigarh, District Saharanpur, be released on bail on their furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
