This application under Section 482, Cr.P.C. has been filed by the applicant praying to quash the summoning order dated 15.4.2013 passed by the C.J.M., Kanpur Dehat as well as entire proceedings of Case No.1023 of 2013, arising out of Case Crime No.308 of 2012, under Sections 406, 323, 504, 506, IPC, P.S. Akbarpur, District Kanpur Dehat, pending in the court of Chief Judicial Magistrate, Kanpur Dehat.
The parties have submitted that they have entered into compromise before the court below and the same has been verified. Certified copy of the order dated 2.11.2018 verifying the signatures of the signatory to the compromise has been brought on record. Even otherwise learned counsel for opposite party No.2 has submitted that the parties have settled their dispute outside the Court.
In view of the settlement between the parties, proceedings of Case No.1023 of 2013, arising out of Case Crime No.308 of 2012, under Sections 406, 323, 504, 506, IPC, P.S. Akbarpur, District Kanpur Dehat, pending in the court of Chief Judicial Magistrate, Kanpur Dehat are, hereby, quashed.
