Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 568 of 2013, under Section 302 IPC, P.S. Iglas, District Aligarh, is seeking enlargement on bail during the trial.
Considering the fact that two prosecution witnesses were examined. The bail application of co-accused Omveer was rejected by coordinate Bench of this Court on 31.08.2016. The case of the present applicant is similar to co-accused Omveer, accordingly I do not find it proper to enlarge the applicant on bail. The bail application of the applicant is hereby rejected.
However considering the peculiar facts and circumstances of the case the trial court is directed to conclude the trial of the applicant within a period of one year from the date of production of certified copy of this order without granting unnecessary adjournments to either of the parties subject to applicants renders fullest cooperation in early disposal of the trial.
Officer is directed to communicate this order to the concerned court within fortnight from the date of production of certified copy of this order.
