Heard Sri K.N. Mishra, learned counsel for the petitioners, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record. No one is present on behalf of the Caveator even in the revised reading of the list.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 11.3.2018 registered as case crime no. 138 of 2018 under sections 420, 467, 468, 471 I.P.C., police station Banna Devi, District Aligarh.
Learned counsel for the petitioners submits that similarly situated co-accused persons against whom different F.I.Rs. have been lodged, have been granted interim protection by this Court vide orders dated 20.7.2017, 20.3.2018, and 29.3.2018 passed in Crl. Misc. Writ Petition Nos. 14062 of 2017, 7255 of 2018 and 7744 of 2018 respectively copies of which have been annexed at page-52 and 55 to 57 of the present petition, hence the petitioners are also entitled for the same relief.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but they shall co- operate with the investigation of the case.
With the above direction this petition is finally disposed of.
