Heard Sri Rohit Upadhyay, learned counsel for the applicant and Sri Sanjay Kumar Singh, learned counsel for the State and perused the record.
The anticipatory bail application under Section 438 Cr.P.C. has been filed by the applicant Vijay Singh, seeking anticipatory bail, in the event of arrest in Case Crime No. 0017 of 2021, under Sections 420, 468, 471 IPC, Police Station Khera Rathour, District Agra.
Learned counsel for the applicant argued that the present matter relates to the appointment of the applicant at the post of Assistant Teacher for which there is an allegation that the degree of Dr. Bhim Rao Ambedkar University, Agra of B.Ed. is alleged to be a forged degree. It is argued that in identical matters there have been orders granting anticipatory bail to other persons who had also sought appointment on the basis of degrees which are alleged to be forged.
Learned counsel for the State opposed the prayer for anticipatory bail.
This Court vide judgment and order dated 21.12.2021 in Crl. Misc. Anticipatory Bail Application No. 18604 of 2021 (Hemant Kumar @ Hemant Kumar Saraswat Vs. State of U.P. and another), has passed a detailed order and the said anticipatory bail application has been rejected.
Looking to the facts of the matter as it is identical to the case of Hemant Kumar @ Hemant Saraswat (supra), the present anticipatory bail application deserves to be rejected.
Accordingly, the bail application is rejected.
