The petitioners herein seek for quashing of the First Information Report dated 03.1.2021 registered as Case Crime No.5 of 2021 under Sections 147, 323, 452, 504, 506 I.P.C. & 3(1)(Da), 3(1)(Dha) S.C/S.T Act P.S-Suriyawan District- Bhadohi.
The contention of learned counsel for the petitioner is that the First Information Report had been lodged as a counterblast to falsely implicate the petitioners herein though the wife of the petitioner no.1 had already lodged a first information report on 3.1.2021 about 12.00 hour or prior to the F.I.R-in-question.
It is, thus, clear that cross case has been lodged by both the parties regarding incident which occurred on 2.1.2021.
It is not possible for the Court to determine as to who was the aggressor of the crime and whether any of the parties had suffered injuries in the incident-in-question. No case is made out for quashing of the F.I.R.
The writ petition is, accordingly, dismissed.
