This writ petition has been filed to seek a direction on the respondent no. 1 to take action against the illegal encroachment on the public pathway.
The report dated 7th February, 2018 shows encroachment on the land in dispute. An appropriate order was passed for removal of the said encroachment in the presence of Sub Divisional Magistrate but according to the petitioner no action has been taken as yet.
In view of the above, this petition is disposed of with a direction to the respondent no. 1 to take action in the matter in consonance to the letter dated 7th February, 2018. The action would obviously be as per the provisions of law and if encroachment exist on the public land/pathway, it would be removed by taking the action within a period of three months from the date of receipt of certified copy of this order.
The compliance of this order would be submitted to the High Court immediately after the expiry of the period of three months.
