Petitioner is an Assistant Teacher in Sri Gandhi Vidyalaya Intermediate College, Kachhwan, Mirzapur. It appears that the Committee of Management of the institution had passed a resolution on 19.01.2018 for placing the petitioner under suspension. This resolution was challenged by the petitioner and the District Inspector of Schools, Mirzapur on 23.08.2018 has disapproved the resolution itself.
Grievance of the petitioner is that despite order of disapproval of petitioner's suspension, he has not been paid regular salary.
Under the facts and circumstances stated above, this petition is disposed off with a direction upon respondent no. 4 to accord consideration for release of salary in accordance with law. In case disapproval order dated 23.08.2018 has not been interfered by any higher forum and there exists no other legal impediment, the salary of the petitioner be released by the competent authority by passing a needful order, after affording opportunity of hearing to respondent no. 6 and 7. The required consideration would be made within a period of two months from the date of presentation of a certified copy of this order.
