After some arguments, learned counsel for the petitioners confines his prayer only to the effect that to direct the Civil Judge (Senior Division) Ballia to decide the Original Suit No.648 of 2009 (Vijay Shankar Upadhyay and others Vs. Sri Niwas Pandey) expeditiously.
Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondents.
Considering the facts and circumstances of the case but without expressing any opinion on the merits of the case and without interfering in the orders dated 06.01.2018 & 27.09.2018 passed by the trial Court, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
