JUDGMENT / ORDER

Rule.
Learned APP Shri R.C. Kodekar waives service of notice of rule for respondent-State.
Present application has been filed by the applicant-accused through jail for the transfer of Sessions Case No.94/2007 to the Sessions Court at Valsad or to the City Civil & Sessions Court at Ahmedabad.
As it transpires, the case was originally pending before the Sessions Court at Valsad, which came to be transferred to the Sessions Court at Navsari as per the order passed in Criminal Misc. Application No.7324/2012 dated 23.10.2012 filed by the complainant. Therefore, in view of the detailed order passed considering the aspect of free and fair trial, the request cannot be entertained. Therefore, present application deserves to be dismissed and accordingly stands dismissed. Rule is discharged.
