Heard learned Counsel for the petitioner and Ms. Subhra Singh, learned Standing Counsel for the State- respondents.
The grievance of the petitioner is that despite there being an injunction granted by the Civil Court vide order dated 24.11.2008 passed in Misc. Appeal No.87 of 2005 against the State and the Tehsildar still operative and the Original Suit for injunction No.772 of 2003 against the Tehsildar and State is still pending, the Tehsildar is meddling with the possession of the petitioner and threatening to demolish the constructions of the petitioner over the suit land. In this respect, the petitioner moved a representation to the Collector, Bijnor on 02.07.2018 (Annexure - 8 to the petition) is stated to be still pending.
Having considered the submissions, we dispose of this petition with a direction to the respondent No.1/Collector, Bijnor to look into the representation of the petitioner, referred to above, and if the facts as stated in the representation are found to be true, the Collector may pass appropriate order, in accordance with law, within a period of four weeks from the date of production of a certified copy of this order.
