Heard learned counsel for the parties.
Appellant/claimant being dissatisfied with the quantum of compensation awarded by the Tribunal has preferred the present appeal for enhancement of compensation.
During the course of argument, learned counsel for the appellant has submitted that if respondent no.2, i.e., Reliance General Insurance Company Ltd., pays Rs. 50,000/- in lump sum to the claimant/appellant in addition to the amount paid under the award, the claim of claimant/appellant shall stand satisfied.
Sri Vijay Prakash Misra, learned counsel for the respondent no.2 submits that his client is ready and willing to pay Rs.50,000/- in addition to the amount which has already been paid to the appellant/claimant under the award towards full and final satisfaction of the claim petition.
In view of the offer accepted by respondent no.2, the appeal is disposed of in terms of compromise and it is provided that respondent no.2 shall deposit Rs.50,000/- with the Tribunal and Tribunal, shall release the same in favour of claimant/appellant within two weeks thereafter.
In case payment has not been made within the aforesaid period by the respondent no.2, the said amount shall carry an interest @ 12% from the date of institution of claim petition.
The appeal is disposed off in terms of compromise.
