JUDGMENT / ORDER

The contention of learned counsel for the petitioner is that the impugned order of transfer has been passed without prior approval of the Police Establishment Board constituted pursuant to direction of the Supreme Court in Prakash Singh and others Vs. Union of India and others 2006(8) SCC 1.
Learned Standing Counsel may file counter affidavit within three weeks.
Connect and list along with writ petition no. 16035 of 2010.
Till the next date of listing the petitioner shall not be relieved in pursuance of the impugned order of transfer dated 31.3.2010.
