Disciplinary proceedings were initiated against the petitioner while placing him under suspension vide order dated 11.9.2018. A chargesheet was initially served whereafter a supplementary chargesheet was also served upon petitioner. Petitioner submitted his reply and an eqnuiry officer had concluded the proceedings by submitting his enquiry report. A show cause notice thereafter has been issued on 20.8.2020 to which petitioner has submitted his reply on 31.8.2020. Grievance is that about six months have expired but till date a final decision has not been taken by the disciplinary authority.
Considering the nature of the order proposed to be passed, no opportunity is required to be given to the respondents for filing counter affidavit, and the writ petition is being disposed of, at this stage itself.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon respondent no.2 to conclude the disciplinary proceedings initiated against the petitioner, within a period of three months from the date of presentation of a copy of this order.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
