JUDGMENT / ORDER

Heard learned counsel for the applicants and learned AGA.
It is contended by learned counsel for the applicants that the report of the State Analysis U.P. Lucknow was challenged by the applicant within 28 days on 18.9.2007 and it was requested for sending the sample to Central Drugs Laboratory, Kolkota but the sample was not sent to the Central Drugs Laboratory, Kolkata and the complaint has been filed on 18.9.2007 on which the cognizance has been taken. There is the violation of provisions of Section 25(3) of the Drugs and Cosmetics Act.
Learned AGA prays for and is granted four weeks' time to file counter affidavit.
Considering the submission made by learned counsel for the applicant and learned AGA, the further proceedings of the complaint case no. 7437 of 2007 under Section 18/27 Drugs and Cosmetics Act, pending in the court of learned CJM, Sharahanpur, shall remain stayed till the next date of listing.
List after four weeks.
