Heard Sri Mahtab Alam, learned Counsel for revisionist and learned AGA for the State-respondents.
Present criminal revision has been filed against the order dated 10.10.2000 passed by 3rd Additional District and Sessions Judge, Saharanpur in Session Trial No.489 of 1998, under Section 308, 452 IPC, Police Station Sadar, District Saharanpur whereby rejecting the application of revisionist for sending his case before Juvenile Court for enquiry.
Learned Counsel for revisionist submits that he is not in a position to state whether trial is concluded or not.
This revision has arisen from Case Crime No.112 of 1987, Session Trial No. 489 of 1998 and there is no stay of proceeding. Probably case would have concluded either in acquittal or conviction.
It appears that either cause of action or any interest to the revisionist no more survives or by efflux of time revisionist lost interest in the matter or it has otherwise become infructuous.
Dismissed accordingly.
However, it is open to the revisionist to approach this Court to recall the order, if any, interest or cause of action still survives.
