Heard Sri Santosh Kumar Chaubey, learned counsel for the revisionist and learned A.G.A. for the State and perused the material placed on record.
The present criminal revision has been moved by the revisionist with the prayer to quash judgement and order dated 14.01.2020 passed by Additional Principal Judge, Family Court, District Ballia in Case No.399 of 2018 (CNR No.UPPL020003712016) (Smt. Manju Devi and another Versus Vijay Kumar Pasi) under Section 125 Cr.P.C., Police Station Gadwar, District Ballia whereby the learned court below has directed the revisionist to pay maintenance allowance to his wife-opposite party no.2 to the tune of Rs.5,000/- per month and Rs.2,500/- per month to her daughter from the date of order.
Learned A.G.A. has accepted notice on behalf of State of U.P.- opposite party no.1.
Issue notice to opposite party nos. 2 and 3 fixing 22.11.2021.
List / put up this case as fresh on 22.11.2021. Meanwhile, learned A.G.A. as well as opposite party nos. 2 and 3 may file reply/counter affidavit.
Under the facts and circumstances of the case, the revisionist is directed to deposit entire arrears of maintenance till date in accordance with order dated 14.01.2020 passed by Additional Principal Judge, Family Court, District Ballia in three installments. Half of the arrears of the maintenance allowance will be payable in favour of opposite party nos.2 and 3 on 11th of October, 2021. Remaining half of the amount will be payable in two equal installments in consecutive months i.e. on 1st of November, 2021 and 1st of December, 2021. Revisionist is also directed to continuously pay maintenance allowance to the opposite party nos.2 and 3 on or before 10th day of each month till disposal of this case. Recovery proceeding against the revisionist shall remain stayed subject to the payment by him as directed above.
