Heard learned counsel for the petitioner, learned Standing Counsel appearing for respondent no. 1 and Sri Jay Ram Pandey, learned counsel for the respondent nos. 2 and 3.
The present writ petition has been filed for a direction to respondent no. 3 to consider the application of the petitioner for recognition of the institution from class 0 to 5 in light of Government order dated 8.5.2013.
Sri Jay Ram Pandey, learned counsel appearing for respondent nos. 2 and 3 has submitted that the petitioner was issued notice dated 27.4.2018, but till date no reply has been submitted by the petitioner, therefore, his matter has not been considered.
Learned counsel for the petitioner submitted that he shall submit reply within two weeks from today and prayed that a suitable direction may be issued to respondent no. 3 to consider and decide the application of the petitioner for grant of recognition, for which learned counsel for the Basic Shiksha Adhikari, Mirzapur has no objection.
Considering the facts and circumstances of the case, this petition is disposed of with a direction to respondent no. 3 that in case any reply of the letter dated 27.4.2019 is submitted by the petitioner alongwith certified copy of this order, the same shall be considered and decided strictly in accordance with law maximum within a period of one month from the date of receipt of reply of the petitioner alongwith certified copy of this order.
It is made clear that the Court has not adjudicated the matter on merits. It is upon the respondent no. 3 to decide the application of the petitioner after considering the facts of the case as well as Rules occupying the field.
