Heard learned counsel for the petitioner and Sri Piyush Shukla, learned Standing Counsel.
Learned Standing Counsel has placed on the record instructions which are marked as 'X' for the purposes of identification. From those instructions, it is pointed out that although the petitioner retired in 2018, he did not hand over charge. He states that although as many as 16 communications have been addressed to the petitioner, that aspect has not been responded to till date. Notwithstanding the above, it is further disclosed that all retirement benefits which were admittedly due and payable including under the head of gratuity and GIS have also been released and that a provisional pension is being paid. There is no disclosure in this respect in the writ petition.
Consequently, the petition shall stand dismissed on the ground of concealment of facts.
