Heard learned counsel for the petitioner and learned A.G.A. for the State.
This writ petition has been filed by the petitioner to issue a writ, order or direction in the nature of mandamus directing the respondents not to arrest the petitioner and with further prayer for quashing the impugned FIR dated 01.11.2017 registered as case crime no.0955 of 2017 under Sections Rohaniya, District Varanasi.
It has been submitted by the learned counsel for the petitioners that the impugned FIR has been lodged by the respondent no. 4 against her husband petitioner as well as against her in-laws containing absolutely false, concocted, vague and sweeping allegations against them that they were demanding dowry from her and her parents and on account of non fulfilment of the alleged demands of dowry she was being tortured and maltreated by them in her matrimonial home.
A bare reading of the impugned FIR goes to show that the allegations do constitute commission of cognizable offence, hence, there is no reason to quash the same.
Writ petition, accordingly, stands dismissed.
