Heard Sri Vikrant Pandey, learned counsel for the petitioner and learned Standing Counsel for respondent no. 1,2 and 3. Nobody has put in appearance on behalf of respondent no. 4 even in the revised call.
By means of this writ petition the petitioner has sought relief in the nature of mandamus to consider his application under Section 67-A of the U.P. Revenue Code, 2006 which is pending consideration before the Sub- Divisional Magistrate, Harraiya, District Basti, namely the respondent no. 3.
The petitioner, during the course of argument, has drawn the attention of the Court towards his application dated 30.6.2019 moved under Section 101 of the U.P. Revenue Code, 2006 and he prays that in the alternative his second application may be granted.
At this stage while the proceedings are pending before the 3rd respondent, propriety does not permit this Court to express any opinion on the merits of the application of the petitioner, however, in the interest of justice the writ petition is disposed of with the direction to the concerned respondent to dispose of both the applications of the petitioner as described hereinabove, within a period of eight weeks from the date of production of certified copy of this order, of course, after giving all the concerned parties reasonable opportunity of hearing.
