The sole relief claimed in the instant petition is for issuing a direction to the Additional Principal Judge, Family Court, Allahabad where Divorce Petition No. 1583/2016, is pending, to decide the same expeditiously.
The petitioner has filed the said petition under Section 13 of the Hindu Marriage Act, 1055. Learned counsel for the petitioner points out that a sum of Rs. 37,000/- per month is being paid by way of maintenance in pursuance of the order passed by the Commanding Officer.
Section 21-B of the Hindu Marriage Act, 1955 specifically provides that all proceedings under the Act should be held on a day to day basis and effort should be made to conclude the proceedings as far as possible within six months from the date of service of the petition on the respondent.
In view of the aforesaid provisions under the Act, I am of the opinion that no further direction is required.
The petition is accordingly disposed of.
