Petitioner's claim for grant of exemption from five years' limitation for grant of compassionate appointment appears to have been forwarded by the Nagar Panchayat Gyanpur, District Bhadohi to the Director, Local Bodies Uttar Pradesh on 24.02.2020. Since no decision has been taken despite expiry of the sufficient time, hence this petition.
The petition is opposed by the learned Standing Counsel on the ground of delay and laches.
This Court has not examined the petitioner's claim on merit particularly, as the competent authority i.e. the State Government is yet to take a decision upon the recommendation made by the Nagar Nigam concerned.
In such circumstances, without entering into the merits of the petitioner's claim, this writ petition stands disposed of directing the respondent no. 2 to take an appropriate decision upon the recommendation made by the respondent no. 3 on 24.02.2020, for condoning the delay in filing of the application for grant of compassionate appointment, within a period of three months from the date of presentation of a certified copy of this order.
