Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Sanjay Kumar Srivastava, learned counsel appearing for the respondent no.4.
By means of this writ petition, the petitioner has prayed for quashing the order dated 26.2.2019 passed by A.D.M. Finance and Revenue Varanasi Division, Varanasi and order dated 20.4.2019 issued by Nayab Tehsildar City Varanasi, District Varanasi.
Against the order dated 20.4.2019 passed under Section 14 of SARFAESI Act, 2002 the petitioner has a statutory alternative remedy of filing an appeal before the Debt Recovery Tribunal under Section 17 of the SARFAESI Act, 2002.
On account of availability of efficacious remedy, we are not inclined to interfere in the matter.
The writ petition is, accordingly, dismissed on the ground of availability of statutory alternative remedy.
