Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482 Cr.P.C. has been filed for quashing the entire proceeding of S. T. No. 95 of 2014 arising out of case crime no. 87 of 2013, U/s 302, 307, 323, 504, 506 IPC and section 3(2)(1) SC/ST Act and section 4/5 Explosive Act, P.S. Sahayal, District Auraiya.
The contention of the counsel for the applicants is that no offence against the applicant is disclosed and the present prosecution has been instituted with a malafide intention for the purposes of harassment. He further contended that the orders impugned have been passed without application of mind.
I have perused the record which shows that there are serious allegations against the present applicant.
It has also not been disputed that in the sessions trial, the final arguments are being heard.
In view of the aforesaid facts and circumstances, no case for interference has been made out.
Accordingly, the instant application is dismissed.
