Heard learned counsel for the parties.
Present application has been filed by the applicant seeking anticipatory bail.
Learned counsel for the applicant submits that under Section 379 IPC, a report was lodged against unknown persons, vide FIR dated 26.7.2019 in respect of Crime No.182 of 2019 at police station Laharpur, District Sitapur, regarding theft of a bike. He submits that during investigation, name of the applicant has come up and the respondents are trying to apprehend him. It has been further argued that on earlier occasion, in four different cases in similar circumstances, F.I.R.s have been lodged by the police under Section 379 IPC against unknown persons in which applicant was arrested and has been granted bail. He further submits that he preferred a writ petition bearing No.1274 (M/B) of 2020, challenging the F.I.R. dated 3.1.2020 in Crime No.0007/2020, under Sections 2 and 3 of U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 at police station Kotwali, District Sitapur, where all the above cases were cumulatively filed against the applicant and mentioned in the gang chart and stay of arrest has been granted by this Court in the said case to the applicant. Learned counsel for the applicant also submits that an interim protection has already been granted by this Court to the applicant, vide order dated 26.6.2020.
Learned State Counsel opposes the prayer made by the applicant.
Considering the rival submissions made by the parties, interim order dated 26.6.2020 is made absolute on the terms and conditions mentioned therein.
Present application is, accordingly, allowed.
The party shall file a computer generated copy of this order downloaded from the official website of High Court Allahabad, self attested by the applicant (s) alongwith a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
