Heard Sri V. Singh, learned counsel for the petitioners and learned Standing Counsel for the respondents.
The petitioners in the writ petition are seeking a direction to respondents no. 3, 4 & 5 not to interfere with the business of the petitioners of sale purchase storage and transportation of Aromatic Cardamom Tincture and further to decide the petitioners' representation dated 2/22.7.2009.
At the time of admission this Court had called for counter affidavit from the respondents and also directed that in the meantime it will be open for the petitioners to approach the concerned competent senior official at the local level who may look into the matter.
Admittedly, no order has been challenged by the petitioners in the present writ petition. Their allegation is that when the goods are taken out of the factory after purchase the members of the Police Department seize the goods and also issue challans. There is no challan which is under challenge before us.
The petitioners want a virtual blanket order restraining the civil authorities from interfering with the business of the petitioners. Such a blanket order cannot be passed unless the petitioners show that in a particular incident respondents acted illegally and interfered with the seizure of goods, and challans to that effect have been issued.
The writ petition is misconceived and is accordingly dismissed.
