Heard learned counsel for the appellant, learned AGA for the State and perused the impugned judgement and order of the trial court.
The present appeal has been filed by the applicant against the judgement and order dated 18.4.2018 passed by Additional Session Judge/ FTC no. 1, Banda in S.T. No. 209 of 2012 (State vs. Vijay @ Bijju @ others) arising out of Case Crime No. 530 of 2012, u/s 498A, 304B, 201 IPC and 3/4 D.P. Act. P.S. Kotwali Nagar, District Banda.
Having heard learned counsel for the parties and considering the fact that the deceased died within seven years of the marriage on account of extensive injuries sustained by her, which, according to the appellant, was sustained in a train accident, which does not find support from the medical evidence, even prior to her death mediation was held between the appellant and the deceased, which shows that the deceased was subjected to torture and ill-treatment by the appellant, who is the husband of the deceased and other family members, I do not find it to be a fit case for enlarging the applicant on bail.
The bail application is, accordingly, rejected.
Office is directed to prepare paper book within two months. List this appeal in the week commencing 4.3.2019 for final hearing.
