Heard learned counsel for the petitioner, Sri Manoj Kumar Yadav, learned counsel for the respondent no.4 and learned Standing Counsel for the respondent nos.1 to 3.
With the consent of the learned counsel for the parties, the writ petition is being disposed of.
The submission of learned counsel for the petitioner is that on Chak road, which is necessary for movement/use for the villagers, respondent no.5 to 8 illegally made the encroachments.
Learned counsel for the petitioner has further pointed out that the proceeding under Section 67 of the U.P. Revenue Code, 2006 was started but till date the same is not concluded, as such, the illegal encroachments still exist.
In view of the aforesaid background, it is hereby directed that the respondent no.3, Sub-Divisional Officer, Tehsil Chandauli, District Chandauli, to proceed in the matter and pass an appropriate order as required under Section 67 of Code, 2006 within a period of 60 days from the date the certified copy of this order is produced before the respondent no.3.
With the aforesaid directions, the writ petition is disposed of.
