Heard learned counsel for the revisionist and learned A.G.A. for the State.
This criminal revision is directed against the judgment and order dated 24.01.2011 passed by Additional Sessions Judge, Court No. 8, Azamgarh dismissing the criminal appeal no. 60 of 2010 (Vijay Bahadur @ Guddu Versus State of U.P. and another) preferred by revisionist against the judgment and order dated16.03.2010 passed by Additional Chief Judicial Magistrate, Court No. 12, Azamgarh in Misc. Criminal Case No. 37 of 2010, by which he convicted the revisionist under Section 31 of the Protection of Women from Domestic Violence Act, 2005 and sentenced him to undergo six months imprisonment and fine of Rs.2000/- and in default of payment further imprisonment of one month.

Without expressing any opinion on merits of the case and considering the facts and circumstances of the case, let the revisionist Vijay Bahadur @ Guddu be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of the Court concerned below in Criminal Appeal No. 60 of 2010, under Section 31 of the Protection of Women from Domestic Violence Act, 2005, P.S. Jahanaganj, District Azamgarh subject to the revisionist deposits the fine within two weeks of his release.
