Heard Sri A.P. Paul, learned counsel for the petitioner and Sri Vashishta Tiwari, learned counsel for respondent.
After some arguments, learned counsel for the petitioner confined his prayer only to the effect that a direction be issued to the appellate Court namely District Judge, Mathura to pass appropriate orders on the stay application filed by the petitioner in Appeal No.29 of 2020. It is further argued that the next date fixed in the matter is 14.01.2021.
Heard learned counsel for the parties and perused the record.
In the facts and circumstances of the case, this petition is disposed of directing the appellate Court namely District Judge, Mathura to decide the injunction application filed by the petitioner expeditiously and preferably on the next date fixed i.e. 14.01.2021. In case, on the said date on account of any reason, hearing could not take place in the aforesaid case, then the appellate Court namely District Judge, Mathura will decide the same expeditiously and preferably within a period of 15 days thereafter.
