The challenge is to the recovery citation dated 13.09.2019 for a sum of Rs.4,00,428/- as electricity dues for unauthorized use of electricity.
The argument is that the said recovery has been issued without providing any checking report and copy of provisional assessment to the petitioner.
The petitioner in paragraph 10 of the writ petition has stated that he had filed objections which means that he was aware of the provisional assessment.
Learned counsel for the petitioner submits that his objections were not decided in finalizing the assessment if any nor the copy of the final assessment has been supplied to the petitioner.
In view of the aforesaid facts and circumstances, we direct the respondent no.2 to provide copy of the checking report, copy of the provisional assessment and to proceed to decide the objections of the petitioner alleged to have been filed on 25.04.2019 (Annexure 4 to the writ petition) in accordance with law if not already decided earlier within a period of one month from the date a copy of this order is served upon him.
The recovery of electricity dues would abide by the order so passed by the Executive Engineer.
The writ petition is disposed off.
