Vijai Shankar Tiwari And Another vs State Of U P And Others

High Court Of Judicature at Allahabad|26 February, 2019
|

JUDGMENT / ORDER

Court No. - 6
Case :- WRIT - A No. - 2005 of 2019 Petitioner :- Vijai Shankar Tiwari And Another Respondent :- State Of U.P. And 9 Others Counsel for Petitioner :- Ram Sajivan Counsel for Respondent :- C.S.C.
Hon'ble Yashwant Varma,J.
Heard learned counsel for the petitioners and the learned Standing Counsel.
This petition impugns an order dated 19 August 2016 pursuant to which the private respondents have been employed as Seasonal Collection Amins.
On the last occasion the petitioners were called upon to explain the evident laches. From the affidavit filed today all that is disclosed is that the petitioner No.1 worked lastly in 2016 and could not approach the Court earlier since his son was undergoing treatment. Insofar as the petitioner No.2 is concerned, it is stated that he was lastly engaged in 2007 and was thereafter busy in arranging for the marriage of his daughter. The Court finds the explanation so proffered insufficient to condone the evident delay.
The petition is dismissed on the ground of laches.
Order Date :- 26.2.2019 faraz
