1. Heard Sri A. N. Pandey, learned counsel for petitioner, learned Standing Counsel for State-respondent and Sri Mrigraj Singh, learned counsel for respondent 2.
2. Petitioner claims to have been appointed by Management, Sangram Balika Inter College, Sarokhanpur, Badlapur, District- Jaunpur (hereinafter referred to as 'College') after notifying vacancy on notice board of College 09.06.1991 whereafter interview was held on 30.06.1991 thereafter letter of appointment was issued on 01.07.1991.
3. From perusal of record it appears that neither document were sent to respondent 2 i.e. District Basic Education Officer, Jaunpur nor vacancy was advertised in newspapers as required under the Rules, therefore, appointment having not been made in accordance with law, petitioner is not entitled for payment of salary from State Exchequer. Hence, relief prayed for in this petition, cannot be granted. Writ petition lacks merit.
4. Dismissed accordingly.
5. Interim order, if any, stands vacated.
