Sri Piyush Shukla, learned Standing Counsel appearing for the State-respondent points out that the present petition has been filed seeking a writ of certiorari to quash an order passed by the Additional District Judge, Ghazipur on an application under Section 9 of the Hindu Adoption and Maintenance Act, 1956. He points out that the order which is sought to be challenged is a judicial order passed by a civil court.
In view of the law laid down in the case of Radhey Shyam vs. Chhabi Nath, (2015) 5 SCC 423, judicial orders of civil courts are not amenable to a writ of certiorari under Article 226.
The petition stands dismissed accordingly.
