The petitioner is a defendant in Original Suit No.550 of 1999 (Sharvan Singh vs. Vidyut Arora) which is said to be pending in the court of Civil Judge Senior Division Baghpat.
The anxiety of the petitioner is that the aforesaid suit may be decided as expeditiously as possible as he is living in Delhi and has to go to Baghpat to attend the hearing on every date.
The above suit is not the suit of the petitioner. There is no averment that any interim injunction or any order is operating therein which may affect the rights of the petitioner.
In view of the above, it is not desirable to issue straightway direction for the speedy disposal of the suit. However, writ petition is disposed with liberty to the petitioner to move an application for early hearing of the suit in the court below itself. In case the petitioner applies to the court concerned for early hearing by means of an application the same shall be considered in accordance with law and it is hoped that the court shall consider it in accordance with law ensuring early disposal of the suit.
With the above observation writ petition disposed of.
