B.BALAKRISHNA, AGA FOR R1-3 & 5; V/O DTD 15.07.2019 SERVICE OF NOTICE TO R4 IS HELD SUFFICIENT) THIS WRIT PETITION IS FILED UNDER ARTICLE 226 AND 227 OF THE CONSTITUTIN OF INDIA PRAYING TO DIRECT TO THE RESPONDENTS TO RELEASE THE GRANTS FOR THE YEARS 2006-07, 2007-08 AND 2008- 09 TOTAL FOR 3 YEARS OF RS.26,40,000/- BY WAY OF WRIT OF MANDAMUS.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri.Jagadeeshachari, learned counsel for the petitioner.
Sri.B.Balakrishna, learned Additional Government Advocate for respondent Nos.1 to 3 and 5.
In this petition, the petitioner inter alia seeks for writ of mandamus directing respondents to release the grants for the year 2006-07, 2007-08 and 2008-09 total for three years of `26,40,000/-.
2. When the matter was taken up today, learned counsel for the petitioner submitted the petition be disposed of with liberty to the petitioner to file a fresh representation to the competent authority with regard to its grievance.
3. In view of the submissions made and in the facts of the case, the writ petition is disposed of with liberty to the petitioner that in case a fresh representation is made by them to the competent authority within a period of two weeks from the date of receipt of the certified copy of the order passed today, the same shall be dealt with by the competent authority in accordance with law by a speaking order within a period of three months from the date of receipt of such representation.
4. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petition is disposed of.
