Heard learned counsel for the parties.
The petitioner is before this Court for a direction to the respondents to ensure the joining of the petitioner on the post of Head Master of the primary institution or Assistant Teacher in Junior High School in view of the fact that she has already been promoted on the said post before her transfer to District Mau and pay her salary along with arrears on that account.
Looking into the nature of issue involved in the matter, the writ petition is disposed of with the observation that in case the petitioner makes a representation to the second respondent, Secretary, Basic Education Board, U.P. Allahabad, the same shall be considered in accordance with law considering the vacancies in various institutions where the petitioner was transferred. The said decision shall be taken, as far as possible, within a period of four months from the date a certified copy of this order along with representation is presented before it.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
