Vidyalata vs State Of U P And Ors

High Court Of Judicature at Allahabad|23 February, 2018
|

JUDGMENT / ORDER

Court No. - 37
Case :- WRIT - A No. - 6616 of 2018 Petitioner :- Vidyalata Respondent :- State Of U.P. And 5 Ors.
Counsel for Petitioner :- Namit Kumar Sharma,Gunjan Sharma,Namit Kumar Sharma Counsel for Respondent :- C.S.C.,Anuj Kumar
Hon'ble Abhinava Upadhya,J.
By means of this writ petition the petitioner claims himself to be Gram Rojgar Sewak appointed under Rural Employment Guarantee Programme in 2006. The said scheme prescribes for period of appointment of Gram Rojgar Sewak which is for a period of one year and in case the services of the Gram Rojgar Sewak is found to be satisfactory, the Gram Panchayat in an open meeting can extend the period for a maximum period of two years, that is to say the appointment of Gram Rojgar Sewak can be for a maximum period of three years at the most. It appears that the petitioner worked from 2006 to 2009 and now she is claiming continuation which cannot be allowed.
Learned Standing Counsel has relied upon a Division Bench decision of this Court in the case of Manjit Singh Vs. State of U.P. and others reported in 2017 (4) ADJ 317 (DB) wherein also similar view has been taken that Gram Rojgar Sewak can work on contract basis for a maximum period of three years, i.e. one year on contract and the Gram Panchayat if found him suitable may extend for two years and after that Gram Rojgar Sewak cannot continue.
That being the case, the petitioner having worked from 2006 to 2009 no relief can be granted.
The writ petition is misconceived and it is, accordingly, dismissed.
