No.2153 of 2014 In spite of service of notice upon respondent No.5, no one has come forward to oppose this writ petition.
This writ petition has been filed challenging engagement of respondent No.5 to take charge of petitioner Samithi and Vidya Vikas Samithi Trust. This Court being prima facie satisfied, passed the following interim order on 6.2.2009.
“Notice before admission.
There shall be interim suspension as prayed for, for a period of (10) ten days from today. However, the petitioner shall not meddle with the properties, both movable and immovable properties, of the Institution in any manner whatsoever.”
This interim order was sought to be vacated by respondent No.6. Upon hearing, this Court by order dt.17.2.2009 made the interim order absolute and since then this order has not been taken to higher forum. We are of the view that since the interim order was allowed to continue, the impugned order lost its efficacy.
Accordingly, we set aside the impugned order. However, we make it clear that in the event the official respondents feel that any lawful action is required to be taken for lawful management and administration of petitioner and Vidya Vikas Samithi Trust, such action may be taken in accordance with law.
The writ petition is accordingly disposed of.
Pending miscellaneous petitions, if any, shall stand closed.
There will be no order as to costs.
W.P. No.2154 of 2009 Since the issue involved in this writ petition is identical to the one raised in the above writ petition (W.P. No.2153 of 2009), the aforesaid order will be applicable to this matter and hence the writ petition is disposed of in terms of the aforesaid order.
Pending miscellaneous petitions, if any, shall stand closed.
There will be no order as to costs.
