Heard learned counsel for the petitioner and the learned Standing Counsel.
The petitioner is aggrieved by an order of transfer pursuant to which she has been posted from Allahabad to Kaushambi.
The circumstances which are enumerated in the writ petition are that the leg of the son of the petitioner has been amputated and that she is undergoing treatment for breast cancer.
Bearing in mind the peculiar facts and circumstances of this case, this Court is of the considered view that the third respondent must be called upon to consider the representation of the petitioner sympathetically and in accordance with law. Accordingly this petition shall stand disposed of with the following directions:-
It shall be open to the petitioner to approach the third respondent by way of a detailed representation within a period of two weeks from today. In case such a representation is made, the third respondent shall duly attend to the same and dispose it of bearing in mind the personal difficulties which are pointed out.
The third respondent shall endeavour to conclude the exercise of consideration within a period of one month from the date of receipt of the representation. Till then the order of transfer impugned herein insofar as it relates to the petitioner shall not be given effect to.
