JUDGMENT / ORDER

THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.22342 of 2006 Between:
1. Vidya Dayini Educational Society, Santoshnagar Colony, Hyderabad, rep. by its Chairman Mr. Sanjjan Singh, and others.
PETITIONERS AND 1. Osmania University, rep. by its Registrar, Hyderabad, and another.
RESPONDENTS ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for the 2nd respondent. None appears for the 1st respondent.
This writ petition was filed challenging the action of the 1st respondent in stipulating additional affiliation fees and various other fees vide demand notice dated 26.09.2006 and 21.09.2006, as illegal, and for a consequential direction to the 1st respondent to collect the affiliation fees as prescribed prior to the fixation of annual fees by the Annual Fees Regulatory Committee-the 2nd respondent herein.
The 1st respondent filed counter affidavit stating that the AICTE, based on the infrastructural facilities provided by the college, sanctioned MBA course with an intake of 60. The Standing Committee at its meeting held on 27.07.2004 after taking into consideration the additional responsibilities on the part of the University in terms of conduct of examinations, prescribed guidelines for sanction of additional sections/new sections and decided to collect the fees as per the letter dated 2.08.2004. Accordingly the management has been asked to pay the amount for considering their request for sanction of additional intake as per AICTE sanction into MCA. The Government has fixed fees for MBA and MCA courses as Rs.23,000/- including tuition fees. The University has taken a decision for collecting one time additional fee of Rs.5,000/- to grant fresh intake in view of the additional services rendered by the university and this is only one time payment that the management is required to pay.
However the learned counsel for the petitioners submits that the petitioners have already paid required fees and the affiliation was also granted for the year 2007-2008 and in view of the same, no further orders are necessary in the present writ petition.
In view of the same, the writ petition is closed. No order as to costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
