A supplementary affidavit has been filed and the same is taken on record.
The petitioner, a student of Bachelor of Ayurvedic Medicine, Ist year, in Jeevak Ayurved Medical College and Hospital, Research Center, Kamlapur, Akauni Chandauli, District Chandauli, applied for fee reimbursement/scholarship as per Government Policy. The petitioner claims to have completed all formalities for said purpose. However, he has not been paid scholarship/fee reimbursement amount compelling him to approach this Court by way of instant writ petition.
The current status of the petitioner's application as displayed on official website is as follows : -
"Under Process. Scholarship & Fee Reimbursement Amount Not Disbursed Due To Unavailability Of Fund."
Learned counsel for the petitioner submitted that the petitioner having been found eligible for fee-reimbursement/scholarship cannot be denied the same on the ground of non-availability of funds.
Learned standing counsel appearing on behalf of State respondents submitted that the respondent No. 2 is competent to examine the grievance of the petitioner.
Accordingly, the writ petition is disposed of by directing respondent No. 2 to pass a speaking order on the claim of the petitioner in accordance with law, within a period of eight weeks from the date of receipt of certified copy of this order along with fresh representation. In case, the claim is found valid and sustainable, the petitioner shall be paid the amount without any delay.
