JUDGMENT / ORDER

1. Mr. Mishra, learned advocate for the petitioner has placed on record a copy of the additional affidavit which, according to his submission, has been served on Mr. Pandya, learned advocate for the respondent on 5.12.2011.
2. When the application is called out and taken up for hearing it is informed that Mr.Pandya, learned advocate for the respondent has filed sick-note. Mr. Mishra, learned advocate for the petitioner has made grievance that since 7.12.2011 matter is being adjourned on account of sick-note filed by learned advocate for the respondent and that therefore any further adjournment may not be granted. However, in due deference to the sick-note filed by the advocate of respondent, the hearing of the petition is adjourned to 27.2.2012.
3. In view of the objection raised by Mr. Mishra, learned advocate for the petitioner on the ground of absence of Mr. Pandya, learned advocate for the respondent, it is necessary to observe that on the said date the Court will proceed with hearing of the matter.
