Heard Sri Manish Kumar Nigam, learned counsel for the petitioner and Sri Tripathi B.G. Bhai, learned counsel for the respondent No.1.
The petitioner has preferred the present petition under Article 227 of the Constitution of India with the prayer toset a side the impugned order dated 05.12.2020 passed by the Additional District Judge, Court No.2 Mathura in Misc. Civil Appeal No.20 of 2018 and order dated 08.05.2018 passed by the Additional Civil Judge (Senior Division) Court No.3 Mathura in Original Suit No.515 of 2013 (Mahendra Kumar Pandey Vs. Vidhish Chand Pandey and another).
After some arguments, learned counsel for the petitioner confines his prayer only to the effect that the aforesaid suit is pending since 2013, till date no final decision has been taken and prays for expeditious disposal of the case.
In the facts and circumstances of the case and without entering into merits of the case, the present petition, under Article 227 of the Constitution of India, is disposed of directing the court below to decide the aforesaid suit filed by the petitioner most expeditiously and preferably within a period of one year from the date of production of a self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
